These Terms and Conditions apply when you:

Curate Aesthetic Clinic is operated by AB Clinics Pty Ltd, ABN 92 688 548 450, trading as Curate Aesthetic Clinic (“Curate”, “we”, “us” or “our”).
By making a booking, purchasing from us or using our website, you agree to these Terms and Conditions and our Privacy Policy.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

3. Website information
Information provided on our website, social media channels, emails and other public materials is general information only.
It is not intended to replace individual medical advice, diagnosis, consultation or treatment. Treatment suitability can only be determined following an appropriate consultation and clinical assessment.
Website content may not include every potential risk, side effect, contraindication or alternative associated with a procedure. These matters will be discussed as part of the consultation and informed-consent process.
You should seek urgent medical assistance by calling 000 if you are experiencing a medical emergency.
4. Treatment information and outcomes
Information about treatments, expected recovery periods and potential outcomes is general in nature. Individual responses vary according to factors including anatomy, medical history, lifestyle, treatment area, treatment selected and adherence to aftercare.
No particular outcome can be guaranteed.
Before proceeding, you may be required to:

A recommendation made during consultation does not create an obligation for you to proceed with treatment.
5. Your responsibility to provide accurate information
You must provide complete and accurate information that may be relevant to your care, including information about:

Medications and supplements

Allergies and previous reactions

Pregnancy or breastfeeding

Recent illness, infection or vaccination

Dental, surgical or cosmetic procedures

Changes to your health after your consultation

You must inform us promptly if any information changes.
Curate is not responsible for consequences resulting from information that has been withheld, omitted or inaccurately provided, except to the extent that responsibility cannot lawfully be excluded.
6. Clinical suitability and our right not to treat
All treatments remain subject to individual clinical assessment.
We may decline, modify, postpone or discontinue a treatment where a practitioner considers that:

The treatment is not clinically appropriate

The potential risks outweigh the likely benefits

Further medical assessment or information is required

Valid consent cannot be obtained

Expectations cannot reasonably be met

The treatment area is infected, inflamed or otherwise unsuitable

The patient appears unwell or impaired
-
Continuing would be inconsistent with professional, ethical or legal obligations
-
The safety of the patient, staff or another person may be affected
Our decision not to provide a particular treatment does not constitute a failure to provide reasonable care.
Where a consultation or clinical assessment has already been provided, the applicable consultation fee may remain payable even when treatment does not proceed.
7. Appointments and bookings
Appointments may be made through our website, patient portal, telephone, email, social media or directly with the clinic.
A booking is not confirmed until:

The clinic has accepted the booking

Any required deposit has been paid
-
You have received booking confirmation
You are responsible for checking that the date, time, treatment and contact details in your confirmation are correct.
Appointment reminders are provided as a courtesy. You remain responsible for attending or changing your appointment even if a reminder is not received.
8. Booking deposits
A deposit may be required to secure an appointment. The amount will be communicated before payment and may vary depending on the appointment type, duration or treatment.
Unless otherwise stated, the deposit will be applied toward the cost of the booked consultation or treatment.
Cancellations and changes with more than 24 hours’ notice
When you cancel or reschedule more than 24 hours before the scheduled appointment time, your deposit may be:

Transferred to a new appointment; or
-
Refunded to the original payment method upon request
Any new appointment remains subject to availability.
Cancellations and changes within 24 hours
Deposits are non-refundable when an appointment is cancelled or rescheduled within 24 hours of its scheduled start time.
The retained deposit contributes toward the time reserved, practitioner availability and reasonable administrative costs associated with the late cancellation.
A new deposit may be required before another appointment can be confirmed.
Failure to attend
Failure to attend an appointment without prior notice is considered a no-show.
Deposits are non-refundable for no-shows, and a new deposit may be required before another appointment can be booked.
Exceptional circumstances
We understand that unexpected circumstances can arise. Requests for an exception may be considered individually at Curate’s discretion. Supporting information may be requested. Consideration of an exception does not guarantee that the deposit will be refunded or transferred.
This policy does not limit any rights you may have under the Australian Consumer Law.
9. Late arrival
Please arrive at the time requested for your appointment.
If you arrive late, we may need to:

Shorten the appointment where this can be done safely
-
Modify the planned treatment
-
Complete only the consultation component
-
Reschedule or cancel the appointment
We will not compromise patient safety, consent or treatment standards to accommodate a late arrival.
Where lateness prevents the appointment from proceeding, it may be treated as a late cancellation and the deposit may be retained.
The full appointment fee may remain payable when a service has already commenced or the allocated clinical time cannot reasonably be used for another patient.
10. Clinic cancellations
On occasion, Curate may need to change or cancel an appointment because of practitioner illness, equipment issues, emergencies, safety concerns or circumstances outside our reasonable control.
Where Curate cancels and cannot provide the booked service, you may choose to:

Transfer your deposit or payment to another appointment; or
-
Receive a refund for the service that was not provided
We are not responsible for indirect expenses such as travel, accommodation, parking, childcare or lost income, except where liability cannot lawfully be excluded.
11. Consultation and consent
Consent is an ongoing process and may be withdrawn at any time before treatment begins.
Separate consent forms, treatment information, prescribing requirements and clinical instructions may apply to particular procedures. Those documents form part of the agreement between you and Curate.
You are encouraged to ask questions and take the time needed to make an informed decision.
Paying a deposit, signing a form or attending an appointment does not remove your right to decline treatment.
12. Treatment plans and timing
Treatment plans are recommendations based on the information available at the time of consultation.
Plans may change because of:

Clinical reassessment

Your response to earlier treatment
-
Changes in your health or medication
-
Product or equipment availability
-
Updated clinical guidance
-
Practitioner judgement
-
Your preferences or treatment goals
Recommended review dates and treatment intervals are guides rather than guarantees that a treatment will be performed at that time.
13. Aftercare and follow-up
You are responsible for following the aftercare instructions provided to you and for contacting the clinic if you experience an unexpected reaction or concern.
You must seek urgent medical assistance when advised or where symptoms may indicate an emergency.
Failure to attend a recommended review or follow reasonable aftercare advice may affect recovery and our ability to assess or manage a concern.
Additional treatment is not automatically included in the original treatment fee unless expressly stated.
14. Prices and payment
Prices are displayed in Australian dollars and include GST where applicable.
Prices may change from time to time. The applicable price will be confirmed before treatment or purchase. Where a personalised quote is provided, it will remain valid for the period stated on the quote.
Unless otherwise agreed:

Payment is required at the time the service is provided

Deposits are deducted from the final appointment balance

Products must be paid for before they are released
-
Gift cards and prepaid packages must be paid for at purchase
-
Outstanding accounts must be paid before further non-urgent services are booked
Treatment recommendations may change following assessment. We will discuss any material change in price before proceeding.
We may use third-party providers to process payments. Their separate terms and privacy practices may also apply.
15. Products
Product information is provided in good faith and does not replace individual medical or skincare advice.
You are responsible for:

Following the product instructions
-
Checking ingredients where you have known allergies

Completing any recommended patch testing
-
Discontinuing use and contacting an appropriate practitioner if an unexpected reaction occurs

Storing products according to their directions
Product availability is not guaranteed, and packaging or formulations may change without notice.
Your rights regarding faulty, unsafe or misdescribed products are protected by the Australian Consumer Law.
16. Gift cards
Gift cards:

Are valid for at least three years from the date of issue unless an exemption applies or a longer period is stated

Must be presented or identified when redeemed
-
May be used for eligible services or products available at the time of redemption

Cannot ordinarily be exchanged for cash
-
Cannot be used to guarantee suitability for a particular treatment
-
Remain subject to consultation, assessment and clinical suitability
-
May not be replaced if lost, stolen, damaged or used without permission, unless Curate can verify the remaining balance and ownership
If the recipient is not suitable for the treatment originally intended, the gift-card value may be used toward another eligible service or product.
Gift cards cannot be used after their expiry date unless required by law or otherwise agreed by Curate.
17. Treatment packages and prepaid services
Packages and prepaid services are subject to:

Any validity period disclosed before purchase

Appointment availability
-
Clinical suitability at each visit
-
The cancellation and no-show policy
-
Any treatment-specific conditions provided at purchase
A package does not guarantee that every planned treatment will remain clinically appropriate.
Where a treatment is no longer suitable, Curate will discuss reasonable alternatives, credit or any remedy required under the Australian Consumer Law.
Unless otherwise stated, packages are for the named patient and cannot be transferred or shared without prior approval.
18. Promotions and offers
Promotions:

Are available for the period stated

Are subject to availability and eligibility requirements

Cannot ordinarily be used retrospectively

Cannot be combined unless expressly stated

May exclude certain products, services or practitioners

Remain subject to consultation and clinical suitability
A promotion does not create an obligation to provide a treatment that a practitioner considers inappropriate.
Any material conditions will be disclosed with the promotion.
19. Clinical photographs
Clinical photographs may be taken where reasonably necessary for assessment, treatment planning, monitoring, documentation or management of a concern.
Clinical photographs form part of your confidential health record.
Identifiable photographs or recordings will not be used for public advertising, social media or promotional purposes without separate and specific consent.
Marketing consent may be withdrawn for future use by contacting us, although withdrawal may not enable us to retrieve content already lawfully published or shared.
20. Privacy
We collect and handle personal and health information in accordance with our Privacy Policy and applicable privacy laws.
By using our services, you acknowledge that relevant information may be shared with practitioners, prescribing clinicians, service providers or other healthcare professionals where reasonably necessary for your care, clinic operations or legal obligations.

21. Behaviour and clinic safety
We are committed to providing a safe and respectful environment.
Abusive, threatening, discriminatory, harassing or unsafe behaviour toward staff, practitioners or other patients will not be accepted.
We may refuse non-urgent services, end an appointment or restrict future bookings where conduct creates an unreasonable safety or wellbeing risk.
This does not affect access to emergency care.
22. Intellectual property
Unless otherwise stated, the content of our website and digital materials—including text, branding, photographs, graphics and design—is owned by or licensed to Curate.
You may access website content for personal, non-commercial use.
You must not reproduce, publish, distribute, modify or commercially use our content without prior written permission, except where permitted by law.
23. Website availability and external links
We take reasonable steps to maintain accurate and available website services but do not guarantee uninterrupted or error-free access.
Our website may include links to external booking portals, payment providers, social-media platforms or third-party websites. We are not responsible for external content, availability, security or privacy practices.
Accessing a third-party service is at your own discretion and may be subject to separate terms.
24. Consumer guarantees and limitation of liability
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies:

25. Concerns and complaints

26. Changes to these terms
We may update these Terms and Conditions when our services, systems, policies or legal obligations change.
The current version will be published on our website with its effective date.
Terms applying to an existing confirmed purchase will not be changed retrospectively where doing so would unfairly disadvantage the customer.
27. Governing law
These Terms and Conditions are governed by the laws of Queensland, Australia.
The parties submit to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them.
